Brazil Enacts “Taylor Swift Law” For Concert Safety & Scalping

The global touring landscape has permanently shifted following Brazil’s groundbreaking new legislation. Signed into law by President Luiz Inácio Lula da Silva, a powerful two-decree package officially dubbed the “Taylor Swift Law” establishes sweeping national standards for concert safety and ticket transparency. Driven by public outrage and relentless advocacy, these measures directly address the systemic vulnerabilities that plagued large-scale live events in South America for years.

Free Water Access & The Legacy of Ana Clara Benevides

The catalyst for this landmark policy stems from a devastating moment during Taylor Swift’s The Eras Tour at Rio de Janeiro’s Nilton Santos Stadium on November 17, 2023. As a brutal heatwave pushed heat index readings to an astounding 59.3°C (138.7°F), 23-year-old fan Ana Clara Benevides Machado suffered heat exhaustion and a fatal cardiac arrest. Stadium rules prohibiting personal water bottles left over 1,000 fans requiring medical attention for severe dehydration, prompting Swift herself to halt her performance to hand out water from the stage.

Under the new health and safety decree, any public or private event—including concerts, festivals, and conventions—with a capacity exceeding 1,000 attendees must provide free, accessible drinking water. Furthermore, venues can no longer ban fans from bringing their own personal water containers, eliminating a predatory stadium practice that put profit over attendee welfare during extreme weather conditions.

Dismantling Scalper Bots and Hidden Fees

The second pillar of the legislation targets predatory ticketing practices that have long frustrated live music fans across the globe. Online ticketing platforms operating in Brazil are now legally required to implement advanced security protocols capable of blocking automated buying bots and bulk-purchasing scripts used by scalpers.

To further protect consumer rights, the decree mandates strict transparency regarding service charges. Ticketing platforms must clearly display all administrative fees and hidden surcharges upfront, prohibiting companies from inflating prices at the final checkout screen. By combining hydration access with anti-scalping reform, Brazil sets a new international benchmark for concert safety, ensuring that fan passion never again comes at the expense of human life.
